Madonna has arrived back in Britain without the child she travelled to Malawi to collect.
As her private jet touched down at Luton airport she was met by ex-husband Guy Ritchie, who following the ruling published a statement describing Madonna as an 'excellent mother'.
As a smiling Guy approached the plane his four-year-old son David leapt into his arms for a kiss.
Mercy was to have been a sister for David, who was adopted from Malawi when he was just 13-months old.
Guy then carried David away from the plane while 50-year-old Madonna disembarked, her bleached blonde hair covering her face.
The singer is said to be devastated after being forced to leave behind the little girl she hoped would become her fourth child and who greeted her as ‘Mummy’ when they met in Malawi last week.
Her lawyer is believed to have filed a notice of appeal to the Malawi supreme court, which will be heard later this week.
Madonna is planning to stay in London with her daughter Lourdes, 12, to celebrate Passover with her friends from the Kabbalah Centre.
Friends say Guy is taking a week off work to take his sons to Ashcombe House, his Wiltshire estate, where he has spent thousands of pounds on new toys, including a new quad bike for Rocco, eight.
Sources in the US have revealed that Madonna had already built a nursery at her Manhattan home which Lourdes had helped her design, ready for Mercy’s arrival.
A friend said: ‘Madonna is in absolute pieces. She is devastated, this is the first time she has not got something she longed for.
'Lourdes will also be devastated. She helped get a room ready for Mercy and chose clothes for her.
‘She was really looking forward to having another girl around.’
